PT Tambang Batubara Bukit Asam Tbk : Anticipating Legal Issues, PTBA Establish Cooperation With South Sumatra High Court

As a world class mining company that is 65 percent controlled by the state and partly by the public, PT Bukit Asam (Persero) Tbk or PTBA trying to keep all of its business activities run in accordance with the legal provisions and regulations. So, PTBA establish cooperation in the field of civil law and state administration with the High Court of South Sumatra Province.

President Director of PTBA Ir. Arviyan Arifin said, in accordance with the vision and mission of PTBA, which is to make a world-class energy company that is environmentally friendly, PTBA not want any legal problems in the implementation of the company's operations. Therefore, PTBA require legal assistance.

'Each activity PTBA certainly relate to the law, and it was definitely,' Arviyan Arifin said after signing the cooperation agreement between PTBA and South Sumatra High Court at Ball Room Arista Hotel, Palembang, in mid November 2016 ago.

Some of the problems that could potentially arise is securing company's assets, land acquisition issues, logistics and CSR.

'We have the energy reserves of up to five billion tons. So, there must be oversight (law --- ed) related exploration that we did,' said Arifin Arviyan.

High court is a state agency that has authority in law enforcement, legal aid, legal considerations and legal services for any business entity under the auspices of the government. As a country lawyer, High Court could be an option for State Owned Enterprises (SOEs) and Regional Owned Enterprises to implement legal assistance on policies and measures implemented.

Arviyan Arifin also said that cooperation with the South Sumatra High Court had last long. Signing of the cooperation that was held on that day was the sixth time.

'We want cooperation with South Sumatra High Court continues to increase, due to the cooperation is very important in running a business,' he said.

Corporate Secretary of PTBA Adib Ubaidullah explained, with the signing of the cooperation, PTBA eligible for legal aid in the form of assistance or legal considerations required in the implementation or acceleration of the implementation of the projects which being executed by the Company.

'With the growing business development that we do, will possibly arise legal issues, both in terms of internal and legal perceptions that come from many sides,' said Adib Ubaidillah.

Meanwhile, Head of the High Court of South Sumatra Susdiyarto Agus Pratomo said cooperation forged between his party with PTBA is an obligation that must be undertaken by his institution in providing services law enforcement, legal aid, legal considerations, and legal services for any business entity in under the government-owned.

'The extent to which the demand of clients, we are ready to assist the civil and state administration,' he said.
