Clarification
Qualcomm's offer to deposit funds against provisional demands raised on Tulip by DoT (Department of Telecommunication) being done on its own accord New Delhi, February 24, 2012 - Tulip Telecom Limited (Tulip), India's leading Enterprise Data Services provider, would like to clarify its stance with regards to Qualcomm's offer to give a deposit to DoT to the extent of demands raised by it on Tulip.
It is understood that Qualcomm has represented before the
Telecom Tribunal, TDSAT and has suo- motto offered to deposit
a sum equivalent to the provisional demands raised by DoT on
Tulip, to enable the DoT to allot License and spectrum for
wireless broadband services. Tulip is not a party to the
petition filed by Qualcomm and has therefore not accepted any
liabilities.
Tulip has represented to the DoT and is providing all
relevant information to enable it to take a decision. Tulip,
at its end, following due process of law and regulation,
intends to pursue the matter with DoT to present its
position, that the provisional demands raised by DoT are
erroneous. Any transaction between Qualcomm and DoT is not at
behest of Tulip and is independent of our representation to
DoT "on incorrect computation of license fee".
Some of the notices/demands raised by DoT pertain to
issues/demands that have been already concluded and the
Company is in process of disputing these notices/demands
before the DoT
Tulip wishes to clarify that with respect to any demand
raised by DoT on Tulip, the Company has always presented its
case along with the relevant details that substantiate its
position, in line with the regulatory and process
requirements.
