ELECTROMAGNETICA SA informs the shareholders and investors that the High Court of Cassation and Justice - Administrative and Fiscal Litigation Section, at the trial date of March 24, 2022, ordered the postponement of the pronouncement on April 7, 2022, of the following actions formulated by the undersigned:

• a) request for referral to the CJEU with a preliminary question;

• b) request to notify the RCC regarding the exception of unconstitutionality of the provisions of art. 19 paragraph 3, art. 33 paragraph 1 and art. 46 paragraph 1 of the Competition Law no. 21/1996; c) appeal filed against the civil sentence no. 1663 pronounced by the Bucharest Court of Appeal in file no. 3970/2/2018, having as object the annulment of an administrative act (Decision of the Competition Council no. 77/2017 sanctioning ELECTROMAGNETICA SA for alleged anticompetitive acts).
