A.M. Best has released the latest installment of its Insurance Law Podcast, a series that examines timely insurance issues from an attorney’s point of view.

This episode features Douglas Moseley, attorney and partner at the law firm of Secrest Wardle, headquartered in Troy, MI, with additional offices in Grand Rapids and Lansing, MI. The firm, which recently celebrated its 103rd anniversary, specializes in defense litigation and counsel for insurance, municipal and commercial clients. The discussion addresses the Michigan Dram Shop Act (Act).

Mr. Moseley defines the Act and explains who can bring a case against a seller of alcohol as well as who can be sued under the Act. He describes scenarios that could result in claims and points out that cases involving drunk driving are the most prevalent source of litigation. He also addresses the requirements that a plaintiff must follow, and what he or she ultimately must prove, to win this kind of case and provides examples of how a bar, restaurant or retail store can build a defense.
